This paper aims to analyse the Administration pre-contractual liability in the public procurement. In adhesion to the thesis sustained by the Plenary Session, on the basis of conflicting Council of State and Supreme Cour t of Cassation case-law, the Authors argue that the Administration pre-contractual liability in the public procurement must be identified, if the legal conditions are met, also before and regardless of the award of a public contract, because since the publication of the invitation to tender, the negotiations originate and must be applied to all the par ties the good faith and fairness duties, the violation of which may create liability for damages.

Gli Autori ricostruiscono la disciplina della responsabilità precontrattuale della Pubblica Amministrazione nelle procedure ad evidenza pubblica per l’affidamento di un contratto di appalto. In adesione alla tesi sostenuta dall’Adunanza Plenaria, gli Autori, ripercorsi gli orientamenti giurisprudenziali contrapposti formatisi nel corso degli anni, sia del Consiglio di Stato sia della SupremaCorte di cassazione, sostengono che la responsabilità precontrattuale dell’Amministrazione, nell’ambito di una procedura di gara, deve essere individuata, laddove ne sussistano i presupposti, anche prima ed a prescindere dal provvedimento di aggiudicazione, in quanto sin dalla pubblicazione del bando e dalla presentazione delle offerte da parte dei concorrenti si instaurano delle trattative nell’ambito delle quali gravano su tutte le parti, e quindi anche sull’Amministrazione, i doveri di buona fede e correttezza, la cui violazione può essere fonte di responsabilità risarcitoria.
