Abstract

The article examines the distinguishing features of constitutional review in the Baltic States, with particular attention for the characteristics of the proceedings. This intra-comparative analysis highlights a remarkable level of homogeneity in the development of constitutional review especially with regard to the modes of access to the Constitutional Courts and the decision-making techniques used during the proceedings. The only exception to this uniformity concerns the effectiveness of the judgments, especially decisions on fundamental rights that have economic implications. In fact, on one hand, the effects of the judgments of the Constitutional Chamber of the Estonian Supreme Court of Justice are often postponed, while the judgments of the Latvian Constitutional Court often have a retrospective effect.
