This volume, the secondo of the CERLIS series, explores some features of arbitration language in the Italian context. This research is based on a corpus of interviews to 14 arbitration practitioners, mainly arbitrators and advocates. The volume consists of two parts. The first deals with controversial aspects of arbitration procedures, such as ad-hoc, institutional and free arbitration, arbitration clauses, confidentiality, cost and duration . A final section esamines the future of arbitration and the linguistic traits that make arbitration language similar to that of litigation.The second part investigates some linguistic traits of these narratives, such as the use of metaphors, linguistic borrowing and code-switching, evaluation as a means of establishing identity, and the inclusion of voices of ‘others’ in these accounts.

Questo volume, il secondo della CERLIS Series, esamina alcune caratteristiche del linguaggio dell’arbitrato, con particolare riferimento alla situazione italiana. Lo studio è basato su interviste a 14 professionisti del settore, per la maggior parte avvocati ed arbitri. La monografia è suddivisa in due parti. Nella prima parte vengono analizzati alcuni aspetti di criticità della procedura arbitrale, quali le differenze tra arbitrato istituzionale, ad-hoc e irrituale, la clausola arbitrale, la riservatezza degli atti e delle procedure, la durata e i costi dell’arbitrato, nonché le prospettive dell’arbitrato come modalità di risoluzione delle controversie. Vengono inoltre considerati i tratti linguistici che rendono il linguaggio dell’arbitrato sempre più simile a quello delle azioni giudiziarie. Nella seconda parte vengono analizzati gli aspetti linguistici della narrazione, con particolare riferimento all’utilizzo di metafore, prestiti e commutazioni linguistiche nonché l’utilizzo del discorso diretto all’interno del flusso narrativo oltre all’utilizzo di enunciati che esprimono valutazioni critiche.
