The aim of this research is to study how Labour Law and Social Security systems can contribute to prevent the early exit from the labour market of people with chronic diseases and promote their return to work. The main objective is to identify alternative ways that allow workers with chronic illnesses to continue working in a manner compatible with their reduced working capacity rather than leaving the labor market prematurely, mainly through dismissal related with capacity or though the access to disability or incapacity benefit. The first chapter analyses the concept and chronic diseases by differencing that from other concepts like disability. The conclusion is that chronic diseases are different from disability and the best solution to protect workers with chronic diseases can not be their assimilation to disabled. The second chapter focuses on the rights of workers with chronic diseases, particularly, the right of non-discrimination and the right to health. Chronic diseases should be considered as an autonomous cause of discrimination. In the third chapter the different measures in force in the legislation, particularly reasonable adjustments and Occupational Safety and Health regulations, that could potentially promote the conservation and return to work of workers with chronic diseases are analyzed. The conclusion is that these measures are not sufficient to adapt working conditions of workers with chronic diseases and that It would be necessary to include in the legislation an specific measure. The forth chapter is about the regulation of the dismissal, with a focus on the reasons that would consent a valid dismissal of workers with chronic diseases. The last chapter provides an overview of the treatment given to chronic diseases by the Social Security systems, focusing attention on the current situation and possible reforms that could be put into practice regarding incapacity benefits and active employment policies.

La tesi di dottorato intende studiare, attraverso un approccio multidisciplinare e comparato, il modo in cui il diritto del lavoro e i sistemi di welfare possono contribuire a promuovere la conservazione e il ritorno al lavoro dei lavoratori con malattie croniche. L’obbiettivo principale è quello di individuare vie alternative che consentano ai lavoratori con malattie croniche di continuare a lavorare in maniera compatibile con la loro capacità lavorativa ridotta invece di abbandonare in maniera prematura il mercato del lavoro, principalmente attraverso il licenziamento per giustificato motivo oggettivo o perché gli viene riconosciuta una pensione di invalidità o inabilità al lavoro. Il modo migliore per tutelare i malati cronici non è quello di equipararli ad altre figure giuridiche come la disabilità, ma individuare tutele ad hoc. Queste tutele potrebbero consistere nel considerare la malattia cronica come una causa di discriminazione autonoma, il diritto all’adattamento delle condizioni di lavoro, una protezione specifica contro il licenziamento fondato nelle cause derivate dalla malattia e, infine, un cambio di prospettiva dei sistemi di welfare che dovrebbero supportare il lavoratore per un adeguato rientro al lavoro invece che promuovere la loro uscita prematura dal mercato di lavoro.
