The present contribute falls within the social-juridical psychology field of study and has the objective to systematize the concept of “Black Pedagogy” (Rutschky, 1977; It. trans., 2015), meant as a set of educational practices assimilable into those that nowadays are included in the frame of physical and psychological maltreatment, and that were particularly common in the past: corporal punishment, tendency to frighten and to anguish children, use of lies, denial of basic needs, propensity to fortify physically, withdrawal of affection, excess of parental control and abuse of parental power, manipulation and humiliation (Kühn, 2014). The reflection on a possible legacy deriving from such educational forma mentis can contribute to the definition of what is commonly intended in society as included in the ius corrigendi justification in relation to the “Abuse of means of correction or discipline” (Art. 571, I.P.C.). Objective of this work is to present the results deriving from a first validation of the “Black Pedagogy Scale”. The questionnaire was administered to 374 subjects and it resulted composed by three factors consistently with what was initially hypothesized on the basis of reference literature: “Values of Black Pedagogy”, “Methods of Black Pedagogy” and “Education of children through time”. This instrument has been designed in order to enlarge on the theme of minors’ protection and to identify elements that can affect the well-being of both children and adults in the social context.

Il presente lavoro rientra nell’ambito degli studi di psicologia sociale-giuridica e ha come obiettivo la sistematizzazione del concetto di “Pedagogia Nera” (Rutschky, 1977; tr. it., 2015) intesa come pratiche educative assimilabili a quelle che attualmente sono inquadrate come forme di maltrattamento fisico e psicologico particolarmente diffuse in passato quali ad es. punizioni corporali, tendenza a spaventare e angosciare, mentire, rifiutare i bisogni fondamentali, temprare fisicamente, operare un ritiro dell’affetto, manipolare, controllare, esercitare il potere genitoriale e umiliare (Kühn, 2014). Una riflessione su un eventuale retaggio di una tale forma mentis educativa può aiutare a contribuire a una definizione della percezione condivisa nella società di ciò che può rientrare nella scriminante dello ius corrigendi in relazione a quanto inteso come Abuso dei mezzi di correzione o di disciplina (art. 571, C.P.). L’obiettivo del lavoro è di esporre i risultati derivanti da una prima validazione della Scala della Pedagogia Nera. Il questionario è stato somministrato a 374 soggetti e risulta composto da tre fattori coerenti con quanto ipotizzato inizialmente sulla base della letteratura di riferimento: “Valori della Pedagogia Nera”, “Metodi della Pedagogia Nera” ed “Educazione del bambino nel tempo”. Tale strumento è stato pensato per ampliare lo studio sul tema della tutela del minore ed individuare elementi in grado di inficiare il benessere sia dei bambini che degli adulti nel contesto sociale.
