La potestà legislativa residuale delle Regioni: dal riparto per materie all’assetto costituzionale dei rapporti Stato-Regioni

The article deals with the legislative powers of the Regions in the frame of the Italian Constitution. Article 117 says that “The regions have legislative power with respect to any matters not expressly reserved to state law”. So, first of all the article explores the general meaning of the “matter”, and the problems which arose around that, then it deepens which matters were actually regulated by Regions, according to scholars and according to the jurisprudence of the Italian Constitutional Court. The last part deals with the new constitutional law which modifies the Constitution and the article analyzes the most probable effects of the reform.

L'articolo tratta della potestà legislativa delle Regioni nel quadro della Costituzione. L'articolo 117 assegna alle Regioni la potestà legislativa nelle materie "non espressamente riservate alla legislazione dello Stato". Dunque, per prima cosa l'articolo indaga il concetto di materia, il suo significato e i problemi che solleva, dopodiché approfondisce quali materie siano concretamente assegnate alla potestà legislativa delle Regioni, secondo la dottrina e secondo la giurisprudenza costituzionale. L'ultima parte dell'articolo prende in considerazione la riforma della Costituzione approvata nel 2016 e ne prospetta alcuni possibili effetti, subordinati all'entrata in vigore.
