The paper analyses the two judgments (decision no. 207/2018 and decision no. 242/2019) of the Italian Constitutional Court concerning the so-called “Cappato case”. The paper focuses on the evolution of the double-decision so-called “doppia-pronuncia”, which in this constitutional trial becomes a two-step decision. By framing these issues, the paper addresses the following questions. Why does the Court decide to postpone the decision? Can we recognise a connection between the first and the second judgment? How this new pattern of deciding may impact the effectiveness of the monito-decision?
