La fideiussione omnibus e la responsabilità della banca tra illeciti antitrust «a monte» e contratti «a valle»

Starting from the judgment No. 29810/2017 of the Italian Supreme Court, in his paper the Author analyses the ongoing case-law concerning the effects on the downstream guarantee contracts of the banking cartel discovered by the National Antitrust Authority in 2005, offering a reading of the private enforcement of antitrust law mainly under the lens of civil law.

Partendo dalla pronuncia della Corte di cassazione n. 29810/2017, nel proprio scritto l’Autore offre una ricostruzione dell’attuale dibattito giurisprudenziale relativo agli effetti sui singoli contratti fideiussori del cartello bancario scoperto nel 2005 dall’Autorità garante della Concorrenza e del mercato, prospettando una lettura del private enforcement del diritto antitrust in una prospettiva civilistica.
