Is the Exception the Rule?! The Collective Agreements in Derogation to the Provisions Regulating the So-Called “Employer-Organised Autonomous Work” (Article in Italian) – Summary. This paper examines the new regulation of the so-called “employer-organised autonomous work” and in particular the collective agreements that may derogate from such regulation according to article 2, section 2, letter a, Legislative Decree No. 81/2015. In light of the review of the single collective agreements as yet in force, the A. expresses some general remarks from both a technical-juridical and trade union perspective and questions whether – considering the wide scope of such agreements and the significant number of workers involved – the exceptions granted by such agreements do not in fact prevail over the general rule provided for by article 2, section 1, Legislative Decree No. 81/2015.
Il saggio prende in esame la nuova disciplina delle collaborazioni organizzate dal committente e gli accordi collettivi in deroga a tale disciplina previsti dalla norma di cui all’art. 2, comma 2, lett. a, d.lgs. n. 81/2015. Alla luce dell’analisi dei singoli accordi, l’A. formula osservazioni di carattere tecnico-giuridico e sindacale e si pone l’interrogativo se – considerato il numero significativo di settori produttivi interessati dagli accordi e l’ampia platea di lavoratori coinvolti – le eccezioni non risultino di fatto prevalenti rispetto alla regola generale prevista dall’art. 2, comma 1, d.lgs. n. 81/2015.
