A case-law trend, shared by a minority, has been consolidating for some years. It claims the necessity to grant a new evidentiary hearing on Appeal not only when the judge of the Court of Appeal delivers a judgement of guilt after an acquittal – this necessity has been made mandatory by a European rule, causing the legislator to change clause 603 of the Italian Code of Criminal Procedure– but also when the judge of the Court of Appeal wants to acquit the accused found guilty at first instance. This is the starting point for the author to criticize the opinions of those who use exceedingly freely the general principles, too often appealed to not only when the regulation is in fact contradictory, ambiguous or incomplete, but also when the interpretation of a clear regulation leads to conclusions the interpreter doesn’t like.
a qualche anno si sta consolidando un orientamento giurisprudenziale, comunque minoritario, secondo il quale il giudice d’appello dovrebbe rinnovare l’istruttoria non solo nel caso in cui intendesse pronunciare una sentenza di condanna dopo un’assoluzione – obbligo che discende dalla regola di matrice europea che ha recentemente indotto il legislatore a modificare l’art. 603 c.p.p. -, ma anche quando volesse assolvere l’imputato condannato in primo grado. L’autore prende spunto da questo tema per criticare quelle interpretazioni che fanno un uso disinvolto dei principi generali, ai quali troppo spesso si fa ricorso non solo quanto la normativa è effettivamente contraddittoria, ambigua, lacunosa, o non in linea con la Costituzione o con la Convezione EDU, ma anche quando l’interpretazione del chiarissimo dato testuale porta a conclusioni che all’interprete non piacciono.
