El control jurisdiccional sobre la discrecionalidad administrativa en Italia

In serving the general interest, the Public Administration make choices and take decisions based on a mandatory examination of the facts and on the assessment of both public and private interests in stake. Such decisions may be characterized by administrative, technical, or technical-administrative discretion. This research works aims to illustrate the different types of discretion, it then reflects on the methods employed for judicial review by Italian administrative judges, and proposes, in a final section, the study of the scope of judicial control in a number of specific sectors and areas of administrative action.
