In three cases within a few months (Landi, De Giorgi and Scavone), the European Court of Human Rights held that Italy had not complied with the Convention obligations in the matter of protection of the victims of gender-based violence; the judgements are examined not only in the light of the violation of the obligations arising from articles 2 and 3 ECHR, but also as a constitutional issue, within the framework of the gender anti-subordination principle of the Italian Constitution. The legal discipline of gender-based violence proves, indeed, to be a crucial area for the construction of constitutional equality. Although the Court, unlike in the previous case Talpis v. Italy, excluded a discriminatory attitude on the part of the authorities, rejecting the alleged violation of art. 14, the worrying failures attested by the cases, seen in their undoubted connection, cannot be considered simple and occasional dysfunctions of individual elements of the system - to some extent unavoidable; rather, these shortcomings show structural defects of the Italian legal system and its lasting difficulty in guaranteeing the so-called “four Ps”: not only an actual and dissuasive Prosecution, but also – at least just as important – Prevention, Protection and Co-ordinated Policies.
Le tre condanne subite in pochi mesi dall’Italia nei casi Landi, De Giorgi e Scavone per l’insufficiente protezione delle vittime della violenza di genere sono esaminate alla luce non solo della violazione degli obblighi positivi di protezione scaturenti dagli articoli 2 e 3 Cedu, ma anche come questione costituzionale, nel quadro del principio antisubordinazione di genere della Costituzione italiana. La disciplina giuridica della violenza di genere si dimostra, infatti, luogo cruciale per la costruzione dell’uguaglianza costituzionale. Benché le condanne, a differenza del precedente Talpis, abbiano escluso il riconoscimento anche dell’art. 14 per discriminazione per ragioni di sesso, le preoccupanti carenze puntualmente attestate dai casi, viste nel loro indubbio collegamento, non possono essere considerate semplici ed occasionali disfunzioni di singoli elementi del sistema – in qualche misura inevitabili – ma ne attestano difetti strutturali e una perdurante difficoltà a garantire le cosiddette «quattro P»: non solo il versante punitivo, nella sua effettività e capacità di deterrenza, ma soprattutto prevenzione, protezione e politiche integrate.
