Il tabellionato in età giustinianea (parte I). La forma degli atti tabellionici e la personalità della prestazione del tabellio.

The paper presents the results of the research about the role of the tabellio examining, in particular the imperial constitutions issued on the subject under the reign of Emperor Justinian (527-565). Referring to a subsequent paper for the analysis of the other issues, this paper, on the one hand, focuses on the constitutions imposing on the tabelliones the obligation of personally carrying out their duties (and therefore punishing those of them who would delegate said duties to third parties) and, on the other hand, it deals with the formal requirements the tabelliones were bound to comply with in the drafting of documents.

Il contributo espone i risultati della ricerca condotta sulla figura del tabellio esaminando, in particolare, le costituzioni in materia emanate sotto il regno dell’imperatore Giustiniano (527-565). Lo studio – rinviando a un contributo successivo l’esame degli altri profili – si concentra, da un lato, sulle norme che imponevano ai tabelliones di svolgere personalmente la propria attività (sanzionando quelli che ne delegassero a terzi lo svolgimento) e, dall’altro lato, esamina le regole formali che i tabelliones erano tenuti ad osservare nella formazione dei documenti.
