The Piedmont Region has inserted an article, number 28-bis, in the regional law 2/2009, concerning the discipline of winter sports in the mountains. This article regulates helicopter flights in mountain areas, in order to protect the environment and to avoid noise pollution. The article analyzes the changes that occurred in the law, the succession of texts approved by the regional legislator from 2009 to 2023, and the content of the rules. Particular attention is given to the interpretative problems that the article 28-bis has generated during its validity, in reference to administrative litigation and to attention from the European Commission in relation to a possible infringement procedure. In fact, the law, formally dictated to protect the environment, contains an authorization regime for helicopter flight activities in the mountains, in particular for hunting and heli-skiing. Among the problems addressed, legislative power is also taken into consideration, which presents profiles of uncertainty in the attribution of the matter to the regional legislator. At the same time, the only constitutional provision relating to the mountains, the article 44 of the Italian Constitution, is essentially forgotten by the legislator and the interpreter, to which however the Piedmontese law can be traced back.
La Regione Piemonte ha inserito un articolo, il 28-bis, nella l.r. 2/2009, riguardante la disciplina degli sport invernali in montagna, che regola il volo nelle aree montane, a tutela dell’ambiente e dell’inquinamento acustico. L’articolo analizza le modifiche intervenute nella legge, la successione dei testi approvati dal legislatore regionale dal 2009 al 2023, il contenuto delle norme. Particolare attenzione è data ai problemi interpretativi che l’art. 28-bis ha generato nel corso della sua vigenza, in riferimento al contenzioso amministrativo e a una attenzione da parte della Commissione europea in funzione di una possibile procedura d’infrazione. Infatti la norma, formalmente dettata a tutela dell’ambiente, contiene un regime autorizzativo per le attività di volo in elicottero in montagna, in particolare al servizio della caccia e dell’eliski. Tra i problemi affrontati viene anche presa in considerazione la potestà legislativa, che presenta profili di incertezza nell’attribuzione della materia al legislatore regionale. Nel contempo, viene sostanzialmente dimenticata dal legislatore come dall’interprete, l’unica norma costituzionale relativa alla montagna, l’art. 44, co. 2 Cost., alla quale pur tuttavia la norma piemontese è riconducibile.
