The essay contributes to the overall analysis – carried out in the collective volume in which it is included – of the reform of the judiciary organization provided for in Law No. 71 of 17 June 2022 (the so-called Cartabia reform), focusing on the new electoral system of the Superior Council of the Judiciary. This system intervenes in an articulated manner on the selection of toga members (with regard to the electorate, candidacies, gender representation), providing for their election, for three quarters, by majority method in large binominal territorial constituencies and, for one quarter, with proportional recovery of the votes of non-elected candidates, linked together. The law also introduces some new principles with respect to the choice of lay members. Albeit with some criticalities, the new system should allow for a sufficiently pluralistic composition of the Council, with toga members from different backgrounds, not necessarily – though more easily – the expression of organized groups, while for the lay members the circumscribed novelties don’t seem to be able to change the the well-established practice of choosing on the basis of links with political forces and a division of seats between them.

Il saggio contribuisce alla complessiva analisi – operata nel volume collettaneo in cui è inserito – della riforma dell’ordinamento giudiziario disposta dalla legge 17 giugno 2022, n. 71 (c.d. riforma Cartabia), concentrandosi sul nuovo sistema elettorale del Consiglio Superiore della Magistratura. Tale sistema interviene in modo articolato sulla selezione dei componenti togati (con riguardo all’elettorato passivo, alle candidature, alla rappresentanza di genere), prevedendo la loro elezione, per tre quarti, con metodo maggioritario in ampi collegi territoriali binominali e, per un quarto, con recupero proporzionale dei voti dei candidati non eletti, collegatisi tra loro. La riforma introduce alcuni principi nuovi anche rispetto alla scelta dei membri laici. Pur con alcune criticità, il nuovo sistema dovrebbe consentire una composizione del CSM sufficientemente pluralistica, con esponenti togati di diversa provenienza, non necessariamente – anche se più facilmente – espressione di correnti organizzate, mentre per i membri laici le circoscritte novità non sembrano in grado di modificare la prassi consolidata, secondo cui la scelta avviene sulla base di legami con le forze politiche e di una spartizione dei posti tra di esse.
