The contribution analyzes the effects on the Houses of Parliament and on the representative relationship resulting from the reduction in the number of members of Parliament deliberated by Parliament in 2019 in light of the simultaneous, continued application of the electoral system set forth in Act no. 165/2017 (the so-called Rosatellum), adapted by Act no. 51/2019. The thesis is that this incisive reduction does not mortify the representative relationship as it has been interpreted in Italy up to now, nor does it prevent the Houses from carrying out the decisive role assigned to them by the Constitution, although it does produce some distortions in the Senate, since in particular territories (Trentino-Alto Adige, Molise, Valle d'Aosta) more senators will be elected than in similar or more populous regions. Instead, it is today's electoral system – together with the "intrusiveness" of the Government and of European and international bodies – which significantly empties the representative relationship of content and which, applied to a smaller number of members of Parliament, produces distorting effects, especially in the Senate. A different mechanism, among many possible ones, must therefore be adopted.
Il contributo analizza gli effetti sulle Camere e sul rapporto rappresentativo derivanti dalla riduzione del numero dei parlamentari deliberata dal Parlamento nel 2019, alla luce della contestuale, perdurante applicazione del sistema elettorale di cui alla legge n. 165/2017 (il c.d. Rosatellum), adattato dalla legge n. 51/2019. La tesi che si argomenta è che tale incisiva riduzione non mortifica il rapporto rappresentativo come finora declinato in Italia, né impedisce di per sé alle Camere di svolgere il determinante ruolo loro assegnato dalla Costituzione, pur producendo al Senato alcune distorsioni, in quanto in particolari territori (Trentino-Alto Adige, Molise, Valle d’Aosta) saranno eletti più senatori che in Regioni analoghe o più popolose. È invece l’odierno sistema elettorale – insieme all’“invadenza” del Governo e degli organismi europei ed internazionali – che svuota di contenuto il rapporto rappresentativo e che, applicato ad un minor numero di parlamentari, produce effetti distorsivi, soprattutto al Senato. Occorre dunque adottare un diverso meccanismo, fra i molti possibili.
