the article examines some of D’Agostino’s works in order to reconstruct a key point of his thought: the emphasis on the relational and co-existential dimension as a fundamental anthropological feature that shapes the law. This assumption is the normative argument on which D’Agostino has founded many of his theoretical reflections. I have focused in particular on three tenets: his theory of justice as order of the coexistence and as recognition of the other; his theory of punishment as a coexistential duty; his anti-individualistic approach to bioethics. In an age of fragmentation and secularization, this «relational paradigm» turns out to be quite suitable to address many challenging issues.
