La sentenza 33/2021 della Corte costituzionale: tra evoluzione della struttura monitoria e inquadramento del divieto di surrogazione di maternità

Constitutional Court ruling N. 33 of the year 2021, offers an opportunity to take stock of the current state of the discussion on surrogacy from a constitutional perspective, questioning the constitutional jurisprudence and its interpretation of the criminal prohibition pursuant to art. 12, co. 6 l. 40/2004. Points of interest also arise observing the evolution of the Constitutional Court’s“warning” judgements (sentenze monito) in the perspective of the dialectic between Legislative and Jurisdiction.
