Fidei tuae committo, ut hereditatem Titii restituas: l’obbligo di restituire un’eredità diversa da quella del testatore

The paper presents the results of the research about the fideicommissa concerning inheritances bequeathed to the testator or to the heir (or the legatee) burdened by the testamentary legacy. The paper focuses on the peculiarity of such a testamentary disposition that, despite not comprising the estate of the testator himself (or a share thereof), raises the same set of problems of a fideicommissum hereditatis as far as the restitutio of the inheritance and the possibility of forcing the burdened heir to accept the testator’s inheritance is concerned.

Il contributo espone i risultati della ricerca sui fedecommessi aventi ad oggetto eredità devolute al testatore o all’onerato (erede o legatario). Il contributo si sofferma sulla peculiarità di tale disposizione testamentaria che, pur non avendo ad oggetto l’eredità del testatore (o una sua quota), solleva le stesse problematiche del fedecommesso universale per quanto riguarda la restitutio dell’eredità e la possibilità di costringere l’onerato ad accettare l’eredità del testatore.
