Comunità Energetiche Rinnovabili. Alcuni profili problematici: nozione di P.M.I., rapporto di mandato e natura imprenditoriale

This essay aims to address some application issues, which have remained on the background until now, arising from the significant regulatory stratification and a multi-level legal framework, by putting into practice the problems highlighted by the increasingly articulated legislative activity in the field of energy. More specifically, the authors try to shed light on the notion of small and medium-sized enterprises in order to identify them as possible members of the REC, on the relationship between individual members and the REC legal entity in relation to the ownership of incentives, and, finally, on the entrepreneurial nature of the REC itself.

Il presente saggio si propone di affrontare alcuni nodi applicativi, finora rimasti sullo sfondo, sorti dalla significativa stratificazione normativa e da un quadro giuridico multilivello, calando nella pratica le problematiche poste in evidenza dalla sempre più articolata attività legislativa in materia di energia. In particolare, gli autori fanno chiarezza sulla nozione di piccola e media impresa al fine della sua individuazione quale possibile membro della CER, sul rapporto tra i singoli membri e il soggetto giuridico CER in relazione alla titolarità degli incentivi, e, in ultimo, sulla natura imprenditoriale della stessa CER.
