After highlighting the relationship between criminal sanctions and the dimension of the sacred, the balance between rights and punishment in the constitutional legal system, the article presents Luigi Ferrajoli’s minimal criminal law paradigm. It identifies the legal instruments to prepare a system of criminal and procedural guarantees. These instruments should offer protection of individual and collective goods and fundamental rights and reduce institutional violence of any crime selection policy.
