Una lettura europea delle sentenze Superlega, ISU e SA Royal Antwerp FC

The three rulings of the Court of Justice dated 21 December 2023 on the activities of sporting federations represent a turning point in the wider context of the European case-law. Apart from the effects that those rulings will produce on the current structure and governance of European sport (in particular, football), the analysis carried out by the Court of justice focuses also on more general aspects linked to the interpretation of Artt. 101, 102 and 165 TFEU and on the relationship between sporting rules and European union law.

Le tre sentenze della Corte di giustizia emesse il 21 dicembre 2023 sulle regolamentazioni adottate dalle federazioni sportive rappresentano una tappa fondamentale nell’ambito della giurisprudenza della Corte di giustizia. A prescindere, infatti, dagli effetti che tali pronunce produrranno sull’attuale struttura e governance dello sport (in particolare, il calcio) europeo, l’analisi svolta dal giudice europeo offre numerosi spunti di riflessione su temi più generali relativi all’interpretazione degli artt. 101, 102 e 165 TFUE e, più in generale, sui rapporti tra le regole sportive e il diritto dell’Unione Europea.
