This essay focuses on a particular profile of the opposition to the donation of immovable property and how it reflects on the problems relating to the circulation of donative property. In fact, the present document attempts to find a solution to the problem of the absence of a rule of intertemporal law, asking whether the twenty-year term under article 563 of the Italian Civil Code also applies to donations transcribed before 15 may 2005, date on which Law no. 80 of 2005 came into force and, if so, what is the dies a quo to be able to exercise the ‘right of self-defence’ constituted by the opposition that can be exercised by future persons entitled by law to a share of the deceased's estate. The question - which can be framed within a broader systemic framework - is fraught with significant practical implications since third-party beneficiaries of the donee, if twenty years have elapsed since the transcription of the donation and no objection has been made to this act, would obtain the consolidation of their property purchase even without the opening of the donor's succession and, on the other hand, persons entitled by law to a share of the deceased's estate would be deprived of the protection in rem.
Il presente saggio si concentra su un particolare profilo dell'opposizione alla donazione immobiliare che si riflette sulle problematiche relative alla circolazione dei beni di provenienza donativa. Invero, tenta di individuare una soluzione al problema dell'assenza di una norma di diritto intertemporale, chiedendosi se il termine ventennale di cui all’art. 563 c.c. si applichi anche alle donazioni trascritte prima del 15 maggio 2005, data dell’entrata in vigore della Legge n. 80 del 2005 e, in caso di risposta positiva, quale sia il dies a quo per poter esercitare il “diritto di autotutela” costituito dall’opposizione esperibile dai futuri legittimari. La questione - inquadrabile all’interno di una cornice sistematica più ampia - è pregna di significativi risvolti pratici giacché i terzi aventi causa dal donatario, qualora siano trascorsi venti anni dalla trascrizione della donazione e non sia stata manifestata opposizione a quest’atto, otterrebbero il consolidamento del loro acquisto immobiliare anche senza l’apertura della successione del donante e, per contro, i legittimari sarebbero privati dalla tutela reale.
