La tutela dei minori stranieri nell’UE tra politiche migratorie e questioni di diritto internazionale privato

The paper examines the legislative framework on the protection of foreign minors contained both in the migration and asylum acts, including those adopted within the New Pact, in particular on the determination of the competence for examining an asylum application, and in the instruments of private international law concerning the adoption of protection measures for children, i.e. the Brussels II ter Regulation and the 1996 Hague Convention. It is questioned whether a «migrant child-friendly framework» emerges, since they share the objective of protecting the best interests of the child.

Il contributo esamina la normativa riguardante la tutela dei minori stranieri contenuta sia negli atti in materia di migrazione e asilo, compresi quelli adottati col Nuovo Patto, in particolare il regolamento relativo alla determinazione della competenza ad esaminare la domanda di asilo, sia negli strumenti relativi ai profili internazionalprivatistici connessi all’adozione di misure di protezione dei minori, ossia il regolamento Bruxelles II ter e la convenzione dell’Aja del 1996. Ci si domanda se ne emerga un «quadro a misura di minore migrante», essendo comune l’obiettivo di tutelare l’interesse superiore del minore.
