The essay focuses on the theoretic and practical value of the official report referring to the context of the Italian legal system. The report constitutes the basic judicial reference for the judge, for the lawyer, and for the public prosecutor, so that the relation between the decision on the actual case and the former decisions of the Corte di cassazione is essentially realized through the report. Since the report connects the new ones with the former decisions, the Ufficio del massimario of the Corte di cassazione turns out to be a crucial entity in the legal system, and plays a fundamental role for the use of precedent, both for the proper understanding and for the reasonable application of it.
