The article examines the impact of Union citizenship on the recognition of personal and family status, with particular regard to children born through surrogacy. Starting from the pluralisation of family models and the crisis of the traditional categories of filiation, it highlights the role of free movement as a criterion for the cross-border continuity of status. The analysis reviews the case law of the Court of Justice on the subject, as well as the most recent judgments of the Italian Constitutional Court, and envisages a possible evolution towards a functional limitation on State discretion, including in the attribution of national citizenship, where this is necessary for the effective enjoyment of rights conferred by Union law. This is achieved through an interpretation of European citizenship as a status of belonging to a “European society” founded on common values and capable of affecting national rules governing personal and family status.
L’articolo esamina l’incidenza della cittadinanza dell’Unione europea sul riconoscimento degli status personali e familiari, con particolare attenzione ai minori nati mediante maternità surrogata, muovendo dalla pluralizzazione dei modelli familiari e dalla crisi delle tradizionali categorie della filiazione, ed evidenziando il ruolo della libera circolazione quale parametro di continuità transfrontaliera degli status. L’indagine ripercorre la giurisprudenza della Corte di giustizia nella materia trattata, nonché le più recenti sentenze della Corte costituzionale italiana, prospettando una possibile evoluzione verso un limite funzionale alla discrezionalità statale anche nell’attribuzione della cittadinanza nazionale, ove necessaria all’effettivo godimento dei diritti dell’Unione attraverso una lettura della cittadinanza europea come status di appartenenza a una «società europea» fondata su valori comuni, idonea a incidere sulla disciplina nazionale degli status.
