As is well known, a variety of factors have recently driven an exponential growth in tourism. Within this phenomenon, a purely commercial logic tends to prevail, ultimately generating diverse and significant negative externalities for both the territory and the resident population. These manifest as a loss of local socio-cultural identity, a deterioration in the quality of life for residents, rising prices, and consequent depopulation, particularly—though not exclusively—within the historic centres of art cities. This paper aims to investigate the instruments that the current legal framework places at the disposal of the public administration to mitigate and manage these negative externalities. It seeks to strike a balance between economic and development needs, on the one hand, and the protection of cultural and landscape heritage, the environment, as well as the identity and liveability of places, on the other. The analysis reveals a framework in which the public administration is endowed—albeit within the bounds of reasonableness and proportionality—with far-reaching powers regarding town planning and the regulation of economic activities, with specific reference to commercial activities.
Come è noto, per una serie di fattori, si registra di recente una crescita esponenziale del fenomeno turistico, nell’ambito del quale tende a prevalere una logica puramente commerciale che finisce per generare diverse e significative esternalità negative sul territorio e sulla popolazione residente, dal punto di vista della perdita di identità socio-culturale del luogo, di peggioramento della qualità della vita dei residenti, di aumento dei prezzi, e di conseguente spopolamento, soprattutto dei centri storici delle città d’arte, ma non solo. Il presente contributo si propone di indagare quali sono gli strumenti che l’ordinamento vigente mette a disposizione della pubblica amministrazione per attenuare e gestire le predette esternalità negative cercando di determinare un equilibrio tra esigenze di natura economica e di sviluppo, da un lato, e salvaguardia dei beni paesaggistici e culturali, dell’ambiente nonché dell’identità e vivibilità dei luoghi, dall’altro lato. Emerge un quadro in cui la pubblica amministrazione è dotata, sia pure in un contesto di ragionevolezza e proporzionalità, di penetranti poteri a livello urbanistico e di regolamentazione delle attività economiche, con particolare riferimento al commercio.
