The essay examines the reform of the action for restitution introduced by Law No. 182 of 2 December 2025, focusing on its impact on the circulation of assets of donative provenance. The reform curtails the in rem protection of forced heirs against third parties, while strengthening the role of registration priority, the stability of acquisitions, and compensation by equivalent value. The resulting framework remains mixed: protection of the reserved share increasingly shifts from the asset itself to its value, without amounting to a full conversion of forced heirship into a purely credit-based entitlement. The essay further highlights the persisting asymmetries between donative and testamentary provenance, questioning the dogmatic coherence of the new balance between forced-heirship protection and transactional security.
Il contributo esamina la riforma dell’azione di restituzione introdotta dalla legge 2 dicembre 2025, n. 182, indagandone l’incidenza sulla circolazione dei beni di provenienza donativa. La novella ridimensiona la tutela reale del legittimario nei confronti dei terzi, valorizzando la priorità della trascrizione, la stabilità degli acquisti e la compensazione per equivalente. Ne emerge un assetto misto, nel quale la protezione della quota di riserva tende a spostarsi dal bene al valore, senza tuttavia tradursi in una piena conversione della legittima in diritto di credito. Il saggio mette infine in luce le persistenti asimmetrie tra provenienza donativa e provenienza testamentaria, interrogandosi sulla tenuta dogmatica del nuovo equilibrio tra tutela dei legittimari e sicurezza dei traffici.
