The paper analyses Italian law and practices on recognition of sex reassignment. While the law does not expressly require the complete body change, that has been the prevailing judicial interpretation. Moreover, judges often require the complete change of primary and secondary sex characters and the sterilisation before granting an ofcial name and sex change, even in the case to be against the will of the transgender person. Because the compulsory nature of surgery on primary sex characters can represent a violation of fundamental rights, a court has submitted such a case to the Constitutional Court, where is now pending.
