The Court of Cassation, following the constitutional judgment 170/2014 in the so-called “Case Bernaroli”, annulled the registration of divorce and stated that the parties’ rights and obligations arising from the marriage bond shall be preserved until the lawmaker will approve a proper form of registered partnership in which it can be converted. The ruling of the judgment 8997/2015 seems convincing, because it both guarantees the effectiveness of decision of the Constitutional Court and emphasises that the transformation of the matrimonial regime into the different legal status of a registered partnership must occur seamless. The judgment, as an earlier decision of the Court of Cassation dealing with the registration of a same-sex marriage celebrated abroad, plays an important role with regard to the heterosexual nature of marriage, which appears transformed from an immutable paradigm to a principle liable to exceptions, even if in a limited and provisional way.
La Corte di cassazione, dando seguito nel caso Bernaroli alla sentenza costituzionale 170/2014, ha annullato la trascrizione del divorzio e dichiarato che alle parti sono conservati i diritti e doveri derivanti dal vincolo matrimoniale sino a che il legislatore non avrà approvato una forma adeguata di convivenza registrata in cui possano transitare. La soluzione data dalla sentenza 8997/2015 appare convincente perché garantisce l’effettività del dispositivo di accoglimento dell’incostituzionalità e perché sottolinea che il transito dal regime matrimoniale al diverso regime giuridico di convivenza registrata deve essere garantito senza soluzione di continuità. La sentenza, come già una precedente decisione della Cassazione in materia di trascrizione del matrimonio same-sex contratto all’estero, ha un ruolo significativo rispetto al carattere eterosessuale del matrimonio, che viene trasformato da paradigma a principio suscettibile di eccezione, sia pure solo limitata e provvisoria.
