In this article, the author analyzes the rules applicable to the online libel. Since the rules of “standard” libel are not applicable to the online case, the author focuses on the applicability of art. 700 c.p.c. in order to obtain the removal of the published libelous article. Finally, the author analyzes the criteria that the judge needs to take into account to determine the compensation: persistency on the network of the harmful information, its availability at any time and everywhere, and its ease of reproduction.
