Carcere e transessualità: la doppia reclusione delle persone transgeneri

The paper proposes an analysis of the legal protection of transsexual persons in Italian prison system through a critical discussion of the National rules and practices. While illustrating the legal protection of incarcerated transsexual persons, this study seeks to determine whether or not the rights and freedoms of transgender persons are efectively protected, and under which conditions. The paper addresses the following questions: what protection emerges from the analysis of the prisons system regarding transgender persons? To what extent and in what ways do transgender persons are efectively protected during the detention? It is argued that Italian prison system presents several limitations with regard to transgender persons, in particular, regarding persons who are ‘transioning’. Considering the limited protection of incarcerated transgender persons under the Italian prison system, the need to ensure full protection emerges with the necessity to fnd a solution more appropriate to the specifcity of situation which could guarantee the fully protection of health and individual rights and freedom.

Il lavoro analizza la condizione trans genere rispetto al quadro normativo e alle pratiche in uso nel sistema detentivo italiano, cercando di verifcare se e in che termini i diritti e le libertà individuali sono efettivamente tutelate. Nel domandarsi quale tipo di tutela emerga dall’analisi del sistema detentivo, si intendono verifcare i limiti emergenti soprattutto rispetto alla condizione di coloro che stanno compiendo la transizione. Considerando le criticità emerse dal contesto carcerario, si pone la necessità di ipotizzare una soluzione che risulti appropriata alla persona transessuale, in grado di garantire la pienezza dei diritti e delle libertà individuali nella peculiarità della vicenda concreta.
