The contribution on Discursive Practices in Arbitration offers discursive perspectives on arbitration focusing on different Asian countries. Maurizio Gotti, Piera Pellegrinelli, and Elena Signorini investigate the texts of both the PRC Arbitration Law and the Law on Mediation and Arbitration of Labour Disputes in order to examine, in particular, the norms concerning the combination of conciliation/mediation and arbitration in Chinese legislation. This combination clearly shows how typical traits of the Chinese legal tradition and social culture have greatly influenced the characteristics of the arbitration process in this country.
