The nature of national sports Federations represents a very complex and complicated issue basically because of their formal status of private associations coupled with their specific functions of general interest. The correct qualification of the nature of national sports federations becomes even more relevant in the context of EU law provisions concerning the procedures for the award of public works contracts and the related notion of body governed by public law. In this paper, the Author examines a recent judgment by the Italian Council of State (Consiglio di Stato is the supreme administrative court) focusing, in particular, on the notion of body governed by public law and its traceability to Italian sports Federations.
