Violazione dell’obbligo informativo e autonoma risarcibilità del danno all’autodeterminazione

The judgment offers its own contribution to the known theme of the patient’s right to informed consent, that has long been the focus of the physician -patient relationship on which the legitimacy of the health worker is based. Adhering to the now consolidated judicial position on the matter, the Supreme Court intervenes in order to reiterate, once again, the compensatory autonomy of the patient’s right to therapeutic self-determination and to formulate some considerations about the extension of the information obligation of the physician and burden of proof to which the patient is kept.

La sentenza in commento offre un proprio contributo al noto tema del diritto del paziente ad acconsentire in modo informato al trattamento sanitario, che costituisce da tempo il fulcro del rapporto medico-paziente su cui si fonda la legittimazione del professionista a prestare la propria attività terapeutica. Aderendo all’ormai consolidato orientamento giurisprudenziale in materia, la Suprema Corte interviene al fine di ribadire ancora una volta l’autonomia risarcitoria del diritto del paziente all’autodeterminazione terapeutica e di formulare alcune considerazioni circa l’estensione dell’obbligo informativo del sanitario e dell’onere probatorio cui il paziente è tenuto.
