The article reinterprets some provisions of the so-called “Workers’ Statute” in the light of the incremental extension of trade union action on environmental law policies that apparently fall outside the selective goal of protecting workers’ collective interest to the quality and healthiness of work environment. Through the historical analysis of the relationship between trade unionism, industry and the environmental issue, the article contributes to highlight how the trade-off between labour and the environment is socially and legally constructed. The article concludes that the contribution of the collective autonomy in deconstructing the alternative between labour and the environment should be selected and promoted also at a normative level.
L’articolo propone una rilettura di alcuni dispositivi dello Statuto dei lavoratori alla luce del progressivo ampliamento delle aree di intervento del sindacato verso questioni di politica (del diritto) ambientale che, solo apparentemente, esulano dalla tutela selettiva dell’interesse collettivo alla qualità e salubrità dell’ambiente di lavoro. Attraverso la ricostruzione storico-evolutiva del rapporto tra sindacato, industria e questione ambientale, l’articolo contribuisce a mettere in luce come la contrapposizione tra lavoro e ambiente sia socialmente e giuridicamente costruita. L’articolo conclude che il contributo dell’autonomia collettiva nel decostruire questa contrapposizione andrebbe raccolto e valorizzato anche sul piano legislativo.
