This comment examines critically the first decision given by an Italian court in relation to the legal nature of cryptocurrencies (or virtual currencies) and the relevant relationship that arises between the user and his/her payment service provider. This comment criticizes the characterization of this relationship offered by the decision in terms of deposit and it advances, instead, the argument according to which the same relationship, in the absence of an appropriate material object, is to be governed under the terms and conditions of agency.

Il saggio analizza, alla luce dell’unica sentenza italiana in materia, la questione della natura delle criptovalute (o valute virtuali) e del rapporto tra cliente e prestatore di servizi relativi alle valute virtuali. Il saggio critica la tesi che le criptovalute possano essere oggetto di un contratto di deposito, per difetto di materialità, e propone un inquadramento del contratto in termini di mandato.
