The article discusses the implications of AI-driven chatbots on users’ mental health. Adopting a comparative law perspective, it examines the legal and technical measures available to protect minors and evaluates the strengths and limitations of relying on tort law as a tool for regulating the conduct of AI developers. Given the growing popularity of AI-enhanced conversational agents among children and adolescents, it finally argues that appropriate design safeguards are essential to mitigate potential harms.
