È antisindacale l’applicazione ai lavoratori iscritti al sindacato dissenziente dell’accordo aziendale che ha previsto la sostituzione di un CCNL con un altro

The Court of Cassation, with order no. 29737 of 11 November 2025, confirmed the anti-union nature of the employer's conduct, who, ahead of its natural expiry date, had disapplied the National Collective Labour Agreement for Metalworkers to some of its employees, applying the National Collective Labour Agreement for the Tertiary Sector to them as well, through a company agreement signed with trade unions other than those to which the employees belonged.

La Cassazione, con ordinanza 11 novembre 2025, n. 2973, ha confermato l’antisindacalità del comportamento del datore di lavoro che, anticipatamente rispetto alla sua naturale scadenza, aveva disapplicato il CCNL metalmeccanici, applicando alla generalità dei dipendenti il CCNL terziario in attuazione di un accordo aziendale sottoscritto soltanto con alcune organizzazioni sindacali.
