Notes on Naples Court of Appeal Judgment no. 6580 of 2025 The judgment of the Court of Appeal of Naples No. 6580 of 2025 clarifies the contractual dynamics between Local Health Authorities (ASL) and accredited private facilities, addressing the complex issue of the remunerability of healthcare services provided beyond the spending cap. In rejecting the appeal of a Campanian ASL that had denied the final payment to a diagnostic center, the judges established that the mere exceeding of the budget does not automatically justify the non-payment, as it constitutes an impeditive fact that the public entity has the burden to formally prove. The administration must comply with strict informative obligations, communicating in advance and in a timely manner the progressive exhaustion of funds to protect the good faith and reliance of the private contracting party. If the ASL omits this essential monitoring, it cannot simply refuse to pay for the services performed beyond the cap, but has a precise contractual duty to adopt a formal and proportional measure of tariff regression to bring the expenditure back within the programmed limits. Finally, the ruling confirms both the jurisdiction of the ordinary judge for such disputes and the applicability of default interest on commercial transactions, reiterating that the public need to contain spending must always be reconciled with the principle of legality, procedural correctness, and the protection of the patrimonial rights of the affiliated facilities operating within the pluralistic system of the National Health Service.
La sentenza della Corte d'Appello di Napoli n. 6580 del 2025 chiarisce le dinamiche contrattuali tra le Aziende Sanitarie Locali e le strutture private accreditate, affrontando la complessa questione della remunerabilità delle prestazioni sanitarie erogate oltre il tetto di spesa. Nel rigettare l'appello di un'ASL campana che aveva negato il saldo a un centro diagnostico, i giudici stabiliscono che il mero superamento del budget non giustifica automaticamente il mancato compenso, costituendo un fatto impeditivo che l'ente pubblico ha l'onere di provare formalmente. L'amministrazione deve rispettare rigorosi obblighi informativi, comunicando preventivamente e tempestivamente il progressivo esaurimento dei fondi per tutelare la buona fede e l'affidamento del contraente privato. Qualora l'ASL ometta tale monitoraggio essenziale, non può semplicemente rifiutarsi di pagare le prestazioni eseguite extra-tetto, ma ha il preciso dovere contrattuale di adottare un formale e proporzionale provvedimento di regressione tariffaria per ricondurre la spesa nei limiti programmati.
