The article examines the trust as an estate-planning device designed to ensure continuity in the care and maintenance of a child with disabilities beyond the parents’ lifetime. Starting from Italian Law No. 112 of 2016 and the concept of the individual life project, the analysis identifies the trust’s concrete care function and the proportionality of its endowment as key elements in the legal assessment of the arrangement. Particular attention is devoted to the interaction between the trust and forced-heirship rules, including reduction claims, as well as to the circumstances in which the trust may operate as a means of performing an existing maintenance obligation. The trust is also compared with other forms of dedicated-asset planning available under Italian law and examined from the perspective of governance, trustee powers and supervisory mechanisms. The analysis ultimately advocates a conception of estate planning that moves beyond the mere allocation of assets and focuses instead on establishing a stable, individualized and enduring organizational framework for the protection and care of a vulnerable beneficiary.
Il contributo esamina il trust quale strumento di pianificazione patrimoniale e successoria destinato ad assicurare continuità alla cura e al mantenimento del figlio con disabilità oltre la vita dei genitori. Muovendo dalla legge n. 112 del 2016 e dalla nozione di progetto di vita, l’indagine individua nella concreta funzione assistenziale e nella proporzionalità della dotazione patrimoniale i criteri decisivi per la corretta configurazione dell’operazione. Particolare attenzione è dedicata ai rapporti con la successione necessaria e con l’azione di riduzione, nonché alla possibilità che il trust assuma, ricorrendone i presupposti, funzione solutoria rispetto all’obbligo di mantenimento. Il trust viene inoltre posto a confronto con gli altri strumenti di destinazione patrimoniale previsti dall’ordinamento e analizzato sotto il profilo della governance, dei poteri del trustee e dei meccanismi di controllo. Ne emerge una concezione della pianificazione ereditaria non più limitata all’attribuzione dei beni, ma orientata alla costruzione di un assetto organizzativo stabile, personalizzato e capace di assicurare nel tempo la protezione della persona vulnerabile.
